The Tort Liability Law has expanded and strengthened the protection of patients′ informed consent
requiring physicians to inform alternative treatment options in addition to risk notifications. Although the diagnosis and treatment technology of traditional Chinese medicine(TCM) is relatively safe and there are relatively few disputes between doctors and patients
the awareness of protecting the right of informed consent of patients is indispensable. Based on the characteristics of TCM diagnosis and treatment
from the 4 aspects of conventional treatment
non-conventional treatment
TCM manipulation and TCM secret recipe
the protection of patients′ informed consent are demonstrated
and the idea and proposal of formulating Guidelines for the Protection of the Right of Informed Consent of Traditional Chinese Medicine Doctors or Regulations on the Risks Notification of Traditional Chinese Medicine Doctors are then proposed. Starting with the principled issues first
and the relevant norms and guidelines could be refined afterwards
standardization and standardized management of the protection of informed consent of patients in the field of traditional Chinese medicine can be achieved.
